Buyers weighing a condominium against a house in Sarasota or on Longboat Key usually compare the two on lifestyle, and then discover the difference that actually matters after closing. It is this: in a condominium, a board you did not elect decides when the roof gets replaced and sends you the bill. In a house, you decide. Everything else — the dues, the approvals, the rules about a boat in the driveway — follows from that one distinction.

What follows is what each structure legally obliges you to fund, and who gets to decide.
Buyers tend to frame this as condo versus house. In practice this market offers three arrangements, and the middle one gets overlooked.
A condominium is governed by Chapter 718 of the Florida Statutes. You own the interior of your unit and an undivided share of the common elements — roof, structure, elevators, grounds — alongside every other owner. The association maintains those elements and assesses you for the cost.
A house in a community with a mandatory association is governed by Chapter 720. You own the lot and the structure outright. The association owns and maintains whatever is common: gates, roads in some communities, drainage, amenities, landscaping in others. It also enforces recorded covenants against your own property. Lakewood Ranch, Country Club Shores and Bird Key, which is single-family only with no condominiums on the island, all sit here.
A house with no association at all still exists in older parts of the city and on parts of the north end of Longboat Key. No dues, no approvals, and no shared money for anything. Whatever fails is entirely yours to schedule and pay for.
Some communities hold both under one roof. In The Meadows, a single master association sits over 52 sub-associations, and some of those are condominium associations while others are homeowners' associations.
Villas and attached homes muddy this usefully. A villa can be legally a condominium even though it looks like a house, and a detached house can sit inside a condominium regime. The name on the listing does not settle it. The recorded declaration does.
This is the sharpest line between the two, and it has moved a long way since 2022.
A condominium association operating a building of three or more habitable stories must obtain a structural integrity reserve study and fund reserves for the components it identifies: roof, structure, fireproofing and fire protection, plumbing, electrical, waterproofing and exterior painting, windows and exterior doors, plus a catch-all for other items above a threshold the state republishes annually. The Department of Business and Professional Regulation's guidance sets out the whole list. Owners can no longer vote those reserves away.
A homeowners' association under Chapter 720 is in a different position. Reserve accounts are permitted rather than required. Under Florida Statute 720.303, an association is treated as having provided for statutory reserves only where the developer established them or a majority of the total voting interests votes to establish them, and members can vote to reduce or waive funding for a budget year. The statute requires a budget without fully funded reserves to carry a legend in capital letters warning that special assessments may result.
Read that contrast carefully, because it cuts both ways rather than favoring one side.
In a condominium, the obligation is mandatory and the amount shows up in your assessment every month. It feels expensive. What you are buying is a building with a funded plan behind it, and a legal floor under that funding.
In a homeowners' association, the assessment is often lower, and part of the reason can be that the community has voted not to fund reserves. The cost has not gone away. It arrives later, as a special assessment, and it arrives whether or not you were the owner who voted. Ask for the budget and look for that capitalized legend. If it is there, the community has told you in writing what it has chosen.
In a house with no association, there is no reserve, no vote and no assessment. There is a roof with a remaining useful life, and it is your job to know what that is.
The milestone inspection program under Florida Statute 553.899 applies to condominium and cooperative buildings of three or more habitable stories. The first inspection falls due by 31 December of the year the building turns 30, measured from the certificate of occupancy, and every 10 years after that, and a local enforcement agency may require the first one at 25 years where local circumstances justify it.
A single-family house is outside the program regardless of age or where it sits, and so is a two-story building. That is a real advantage for the house — one fewer report to read, one fewer engineering finding capable of triggering an assessment.
It is also a gap. Nobody is required to inspect that house on a schedule and file the result with the building department. On a condominium of the right height and age you can ask for a structural report prepared by a licensed engineer and read what it found. On a house, that report exists only if you commission it. Inside a gated community the condominium-or-house question is often the wrong one, because certain rights attach to the address rather than to the building type.
Bay Isles on Longboat Key is the clearest example, and it is the point buyers get wrong more often than any other in this market. The Bay Isles Beach Club, at 2111 Gulf of Mexico Drive, conveys with every home inside the gates, deeded, whether that home is a condominium unit or a single-family house across sixteen residential neighborhoods. The Longboat Key Club golf membership does not convey. It is a separate membership with its own buy-in. Buyers who have owned in Florida before make this mistake as often as first-time buyers do.
The general rule is to stop reasoning from the building type and start reading the declaration. Ask what is deeded, what is licensed, what is a separate contract, and what a future board could change.
A condominium association typically holds approval rights a homeowners' association may not: approval of a purchaser or a tenant, limits on how often a unit may be leased, a minimum lease term stricter than the zoning district requires, renovation approval reaching inside your own walls, and rules on flooring, windows and exterior finishes that exist because the components are shared.
A homeowners' association enforces covenants against a property you own outright. That is generally lighter, but it is not nothing: paint colors, roof materials, fencing, boat and vehicle storage, and short-term rental restrictions all commonly live in a Chapter 720 declaration.
Two practical points apply to both. Restrictions can be amended after you buy, by a vote you may lose. And in both structures the records are reachable: condominium associations with 25 or more units have been required since 1 January 2026 to give owners access to official records online, and homeowners' associations with 100 or more parcels have been required since 1 January 2025 to post their governing documents and annual budget on a website or downloadable application. A seller who cannot produce those records quickly is worth a follow-up question.
Strip it back to four questions and the answer usually presents itself.
How much of the maintenance do you want to be responsible for scheduling, and how much do you want handled without you? How much of the decision-making are you willing to hand to a board? Are you prepared to read a reserve schedule every year, or would you rather own the roof outright and manage it yourself? And how long do you expect to hold the property, since a deferred reserve becomes a real problem for whoever owns on the day the work happens?
Cost per month is the wrong comparison. Total cost of ownership across the years you plan to own is the right one, and it takes the budget, the reserve position and the insurance structure together. Judge an agent on whether they can price the two structures against each other rather than describe them. Three things separate them. Whether they will read a condominium's reserve schedule and an association's budget legend before an offer is written, since that is where the two options genuinely diverge. Whether they can say what conveys with a specific address and what is a separate buy-in, which inside a gated community matters more than the building type. And whether they will tell you a lower monthly assessment is sometimes a community that voted not to fund reserves. Danielle Gladding & Co. Yes. Older parts of the city and portions of the north end of Longboat Key include houses that carry no mandatory association membership, no dues and no architectural approval requirement. The trade is that no shared fund exists for anything, and no recorded covenant restrains what a neighbor builds beyond what zoning allows. Confirm it rather than assume it. A recorded declaration binding the parcel will appear in the county official records whether or not anyone mentions it during a showing.
A regular assessment is the budgeted amount every owner pays on a recurring schedule to run the association and, where reserves are funded, to build them. A special assessment is a separate levy for something the budget did not cover, most often a roof, a structural repair, an insurance shortfall or a legal matter. In a condominium the share is set by the percentage in the declaration rather than divided evenly. Approved and levied special assessments appear on the estoppel certificate; ones the board has merely discussed appear only in the minutes.
