Longboat Key Rental Rules and Minimum Stays

Disclosure: Nick Gladding, Danielle Gladding's husband, was sworn in as District 3 Town Commissioner for the Town of Longboat Key in March 2026. This post describes rental rules set by the Town's code, which the Town Commission adopts and amends.

On most of Longboat Key, a home or condo on residentially zoned land cannot be rented for less than 30 consecutive days, or one full calendar month. Short stays are allowed only on tourism-zoned property or property the Town recognizes as a grandfathered tourism use. Any residential rental shorter than six months must also be registered with the Town. Those three facts decide whether a Longboat Key property works as a rental before anything else does.

What is the minimum rental period on Longboat Key?

The Town of Longboat Key states it directly: unless a property is grandfathered as a tourism use or sits in a tourism-zoned district, "the minimum length of each individual rental period shall be at least 30 consecutive calendar days, one entire calendar month, or longer." The rule traces to Ordinance 82-10, adopted in 1982, which first separated residential zoning from tourism zoning on the island.

Tourism-zoned properties, largely the island's resorts and hotel-style condominiums, may be rented for shorter stays. Everywhere else, including the single-family neighborhoods and most residential condominium buildings, the 30-day floor applies. Each day a property is rented in violation counts as a separate offense under the Town code, and repeat violations can lead to a lien on the property.

Why does Longboat Key's rule survive Florida's vacation rental law?

Section 509.032(7)(b) of the Florida Statutes bars local governments from prohibiting vacation rentals or regulating how long or how often they are rented. The same paragraph exempts any local law adopted on or before June 1, 2011. Longboat Key's limits date to 1982, so they stand.

That grandfathered status is why Longboat Key reads so differently from nearby areas whose rules were written later. For a comparison, see our guide to Siesta Key rental rules. As of the 2026 session, no new state law has changed this: a 2024 bill that would have preempted local registration programs was vetoed, and nothing has replaced it.

Do Longboat Key rentals have to be registered?

Yes. Since October 1, 2023, Chapter 115 of the Town code has required any residentially zoned property rented for less than six months to hold a Residential Rental Certificate of Registration. The requirements include:

  • A Town Business Tax Receipt before any rental transaction
  • A safety inspection, by the Fire Marshal or Code Enforcement depending on the property's classification
  • The certificate number in every advertisement, including Airbnb and VRBO listings
  • Emergency contacts and Town information posted inside the unit
  • Renewal of the certificate every two years

Fees and forms are on the Town's Residential Rental Registry page, and the Town Clerk's office handles business tax questions.

Can a condo association restrict rentals further?

Yes, and on Longboat Key it frequently does. The Town's 30 days is a floor, not a promise. A condominium's declaration can set a longer minimum lease, limit the number of leases per year, require board approval of tenants, or bar leasing during an owner's first year. Some buildings on the island set minimums well above the Town's, so no two associations can be assumed alike.

Florida law limits how a new restriction reaches existing owners. Under section 718.110(13), an amendment that prohibits rentals, changes the rental term, or limits how often a unit may be rented applies only to owners who consent to it and to owners who take title after it takes effect. A buyer takes title subject to every amendment already in place, which is why the declaration and its amendments belong at the top of the reading list. Gated communities add their own layer. Inside Bay Isles, for example, each neighborhood association has its own documents alongside the master association's, and both can address leasing.

What taxes apply to a Longboat Key rental?

Under section 212.03 of the Florida Statutes, rentals of six months or less are transient rentals, subject to state sales tax and the county's tourist development tax. A bona fide written lease for longer than six months of continuous residence is not taxed that way. Longboat Key sits in two counties, Sarasota to the south and Manatee to the north, and the tourist development tax is collected by the county the property is in. Confirm the property's county before you register for collection.

What should you check before buying a Longboat Key property to rent?

  1. The zoning district. Residential or tourism, and whether the Town recognizes any grandfathered tourism use. The Planning, Zoning and Building Department can confirm it.
  2. The declaration and every amendment. Minimum lease term, leases per year, approval process and any first-year restriction.
  3. The association's rules and regulations, which can govern guest registration, vehicles, pets and move-in fees.
  4. The county, which determines where transient rental taxes are filed.
  5. The management structure. Whether you will manage from a distance, hire a local manager, or rely on the association's on-site staff.

What happens if a Longboat Key rental breaks the 30-day rule?

The Town of Longboat Key enforces the minimum through code enforcement citations. Each day a property is rented in violation counts as a separate offense, fines increase for repeat violations, and repeated violations can lead to a lien on the property. Because every listing must show the Town's registration number, an unregistered short stay is easy to spot. For a buyer, the association's record of rental violations is worth asking about before closing.

Does a new condo rental restriction apply to an owner who already owns a unit?

Generally not, under section 718.110(13) of the Florida Statutes. An amendment that prohibits rentals, changes the rental term or limits how often a unit may be rented applies only to owners who vote for it and to owners who take title after it takes effect. A buyer, however, takes title subject to every amendment adopted before the closing, including recent ones the seller was exempt from.

Do I need to register a Longboat Key home I rent for the whole season?

If the rental is shorter than six months, yes. The Town's registration applies to any residentially zoned property rented for less than six months, which covers a typical January-through-April season. Registration requires a Business Tax Receipt, a safety inspection and renewal every two years. A bona fide written lease longer than six months falls outside the registry and outside Florida's transient rental tax on accommodations.
