Siesta Key Rental Rules

On Siesta Key, whether you can rent your home for a week comes down to two things: which jurisdiction the parcel sits in, and how that specific parcel is zoned. Most of the island is unincorporated Sarasota County, where the minimum rental period in most residential zones is thirty days. The exception is parcels zoned Residential Multi-Family on the barrier islands, where shorter stays may be permitted.

That single distinction decides whether a property is an income asset or a second home, and buyers get it wrong constantly — usually because a listing said something optimistic, or because a previous owner rented weekly and nobody stopped them.

This is what we walk buyers through before an offer is written on Siesta Key, and it is the conversation that saves people the most money.

The Short Version

  • Unincorporated Sarasota County — most residential zones require a minimum lease of thirty days.
  • The barrier island exception — parcels zoned Residential Multi-Family, or RMF, on Siesta, Casey and Manasota Keys may permit stays under thirty days.
  • Single-family zoning — short-term rental is generally prohibited, anywhere in the unincorporated county, Siesta Key included.
  • City of Sarasota — a different regime entirely, with a shorter minimum stay and a mandatory registration certificate.
  • None of it is optional. Zoning is a matter of record, and enforcement is real.

Step One: Which Jurisdiction Is the Parcel In?

This is the question almost nobody asks first, and it is the one that determines everything else.

Most of Siesta Key lies in unincorporated Sarasota County. Some Sarasota-area property sits inside the City of Sarasota, and the two have different rules. A buyer who reads the City's rules and applies them to a County parcel has just made a very expensive mistake.

Jurisdiction is not something to assume from an address or a mailing city. It is verified parcel by parcel, and it should be verified before the inspection period ends.

Step Two: How Is the Parcel Zoned?

Within unincorporated Sarasota County, zoning determines the minimum rental period.

Residential Single-Family

In single-family residential zoning, the general rule across the county is a minimum lease of thirty days. That prohibition applies to the barrier islands — Siesta Key, Casey Key and Manasota Key — in full.

If a single-family home on Siesta Key is being marketed as a weekly or nightly rental, that is worth a very hard look regardless of what a listing says or what the current owner has been doing. A previous owner's practice is not a permission.

Residential Multi-Family

The exception is parcels zoned Residential Multi-Family. On the barrier islands, RMF-zoned property may permit rentals under thirty days. That is why so many of the island's condominium complexes operate as weekly rentals while the house two streets inland cannot.

It is also why buyers who want rental income on Siesta Key end up looking at condominiums rather than houses. The zoning, not the building type, is doing the work.

Step Three: The Association Can Be Stricter Than the County

Zoning sets the outer limit. Your condominium or homeowners association sets its own, and it can be tighter.

An RMF-zoned building where the county permits weekly stays may still have recorded documents requiring a thirty-day, sixty-day or ninety-day minimum, or limiting the number of rentals per year, or requiring board approval of tenants. Some buildings restrict pets, or vehicles, or the number of occupants.

Read the recorded documents. Not the listing remarks, not a summary, and not what the seller says the rules are. The declaration and the rules and regulations are the documents that govern, and they are available before you close.

The Siesta Key Overlay District

Siesta Key carries an additional layer. The Siesta Key Overlay District, or SKOD, modifies how county zoning applies on the island — parking ratios, alternative parking surfaces, landscaping and other standards specific to a barrier island with limited room.

SKOD does not replace the underlying zoning. It sits on top of it. For a rental property, the parking standards in particular are worth understanding, because parking is one of the more common friction points between a rental operation and its neighbors.

Grandfathered Properties

Sarasota County recognizes certain short-term rental units that documented qualifying use before September 30, 2003. Where that status exists, it attaches to the property, and owners are subject to inspection access and Siesta Key Overlay standards.

This is a narrow category and a valuable one, and it is exactly the sort of thing a seller may believe applies without documentation to support it. If a property is being sold on the strength of a grandfathered status, ask to see the record.

Zoning Is Not the Only Requirement

Even where short-term rental is permitted, zoning is the first hurdle rather than the last.

  • State licensing. Florida's Department of Business and Professional Regulation licenses transient public lodging. Most short-term rentals require one.
  • Tax registration. State sales tax and county tourist development tax both apply to short-term rental revenue and both have to be registered and remitted.
  • County registration. Where the county requires registration, it comes with an annual fee.
  • Insurance. A standard homeowners policy generally does not cover transient rental use. This is a conversation to have with your carrier before the first booking, not after a claim.
  • Financing. Lenders treat a property with rental income differently. If you are borrowing, raise it early.

What Enforcement Actually Looks Like

County code enforcement can issue notices, take cases before a special magistrate and levy fines. Neighbors report violations, and on an island where parking and noise are already sensitive, they report them fairly readily.

The financial exposure is not only the fine. A property purchased on the assumption of weekly rental income that cannot legally produce it is worth what it is worth as a second home, which may be a very different number from the one in the pro forma.

How to Verify Before You Make an Offer

The sequence that avoids trouble:

  • Confirm the jurisdiction for that specific parcel — County or City.
  • Confirm the zoning designation for that specific parcel, in writing, from the county.
  • Request and read the association's recorded declaration and rules, not a summary.
  • Ask about grandfathered status and ask to see documentation of it.
  • Confirm what licensing and tax registration will be required.
  • Talk to your insurance carrier and, if borrowing, your lender.
  • Do all of it before your inspection period ends.

None of these steps is difficult. What makes them matter is doing them in that order, before the offer rather than after the closing.

What This Means If You Are Buying

If rental income is central to why you are buying on Siesta Key, the zoning question comes before the property search rather than after it. It narrows what you should be looking at, and it narrows it early enough to save you time.

If rental income is a nice-to-have, it still belongs in the analysis, because a property that cannot be rented short term should be valued as what it is.
